These Terms of Service ("Terms") govern your access to and use of the website located at goghpara.com (the "Site") operated by Gohi LLC d/b/a Gogh Para ("Gogh Para," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

Important: Gogh Para is a Licensed Legal Paraprofessional authorized by the Minnesota Supreme Court under Rule 12. Gogh Para is not an attorney and is not a law firm. All services are provided under the supervision of a licensed Minnesota attorney as required by Rule 12 of the Minnesota Court Rules — Rules for Supervised Practice.

1. Nature of Services

Gogh Para provides licensed legal paraprofessional services within the scope authorized by Minnesota Rule 12, including limited family law matters, expungement, housing and tenant disputes, conciliation court representation, and administrative hearing representation. All services are delivered under the supervision of a licensed Minnesota attorney.

Gogh Para operates exclusively within the scope authorized by Rule 12 and reserves the right to decline or withdraw from any matter that falls outside that authorized scope. The specific services Gogh Para is authorized to provide are limited and defined by Rule 12 and may change as the rule is amended.

2. No Attorney-Client Relationship from Website Use

Visiting this Site, reading its content, submitting a contact form, or completing an intake form does not create a client relationship between you and Gogh Para. A client relationship is formed only when Gogh Para has (a) conducted a conflict of interest screening, (b) confirmed that your matter falls within the scope authorized by Rule 12, (c) agreed to accept your matter, and (d) both parties have executed a written service agreement.

Until a written service agreement is executed, no client relationship exists. However, Gogh Para will treat all pre-engagement communications — including form submissions — with confidentiality and care (see Section 8).

3. No Legal Advice

The content on this Site is provided for general informational purposes only and does not constitute legal advice. The information presented should not be relied upon as a substitute for individualized guidance from a licensed paraprofessional or attorney. Every legal situation is unique, and the information on this Site may not apply to your specific circumstances.

Do not act or refrain from acting based on any information on this Site without first seeking professional guidance through a paid consultation.

4. Consultation Fee

4.1 Fee and Credit

All engagements begin with a paid consultation. The current consultation fee is $100. If you retain Gogh Para for services following the consultation, the full consultation fee is credited toward your service fee.

4.2 Refund of Consultation Fee

The consultation fee is refundable under the following circumstance:

4.3 Non-Refundable Consultation Fee

The consultation fee is non-refundable when the client has been informed, through the intake form or otherwise, that their matter may fall outside the scope of services authorized under Rule 12, and the client has acknowledged this notice and elected to proceed with the consultation. In these cases, the consultation still provides substantive value: a thorough review of your situation, a definitive scope determination, and a referral to an appropriate attorney or other resource if Gogh Para is unable to assist.

4.4 Intake Form Acknowledgment

Before scheduling a consultation, you may be asked to complete an online intake form that includes screening questions about the nature of your legal matter. If your responses indicate that your matter may fall outside Rule 12 scope, you will be presented with a clear notice explaining this possibility. By proceeding to book and pay for the consultation after receiving this notice, you acknowledge that you have read and understood the notice and that the consultation fee is non-refundable under these circumstances.

5. Service Fees and Refund Policy

5.1 Flat-Fee Pricing

Gogh Para uses flat-fee pricing for all services. Your specific fee will be determined during or after your consultation based on the nature and complexity of your matter. The fee will be set forth in your written service agreement before any work begins. All fees include document preparation, filing, court or hearing appearances, and attorney supervision as applicable to your matter.

5.2 Refund Policy

We understand that circumstances change. If Gogh Para must withdraw from your matter due to a conflict of interest, a determination that the matter falls outside the scope authorized by Rule 12, or other circumstances requiring withdrawal, the following refund schedule applies:

This refund policy reflects our commitment to acting with integrity and ensuring that clients are not financially penalized when representation must end due to circumstances related to scope or conflict. Refunds will be issued within thirty (30) days of the withdrawal determination.

5.3 Client-Initiated Termination

If you choose to terminate the engagement, the refund amount will be determined based on the work completed to date. Gogh Para will provide an accounting of work performed and issue any applicable refund in accordance with the terms of your service agreement and applicable professional rules.

6. Conflict of Interest Screening

Due to related professional commitments, Gogh Para conducts a thorough conflict of interest screening before accepting any matter, with particular attention to family law cases. This screening may occur at intake, during the consultation, or at any point during representation if new information comes to light.

If a conflict of interest is identified, Gogh Para will decline or withdraw from the matter and, where possible, provide a referral to an appropriate attorney or licensed paraprofessional. Applicable refunds will be issued in accordance with Sections 4.2 and 5.2 above.

7. Scope Limitations and Right to Decline

Gogh Para is authorized to provide services only within the specific scope defined by Minnesota Rule 12. If at any point during or after consultation we determine that your matter falls outside our authorized scope — or if your matter evolves beyond what Rule 12 authorizes us to handle — we are required to decline or withdraw from representation.

Matters that fall outside Gogh Para's scope include, but are not limited to: criminal cases, estate planning (wills, trusts, probate), family law matters involving allegations of domestic abuse, child abuse, or sexual violence, complex asset disputes, CHIPS petitions, and any matter outside the scope authorized by Minnesota Rule 12.

If we must decline or withdraw, we will explain the reasons transparently and, where possible, provide a referral to an appropriate attorney. You will never be left without a path forward.

8. Communications & Confidentiality

Communications between you and Gogh Para — whether made before or after a service agreement is signed — are not privileged in the same way that attorney-client communications are privileged. A Licensed Legal Paraprofessional is not an attorney, and the attorney-client privilege does not apply.

However, Gogh Para will treat all communications with confidentiality and care. We will not voluntarily disclose information you share with us except as required by law, court order, or professional obligation. Once a client relationship has been established (as described in Section 2), Gogh Para is bound by the ethical obligations set forth in Minnesota Rule 12, including duties of confidentiality and competence.

Pre-engagement communications — such as information submitted through the contact form or intake form — will also be treated confidentially, even if no client relationship is ultimately formed.

9. Intellectual Property

All content on this Site — including text, graphics, logos, images, and design elements — is the property of Gohi LLC d/b/a Gogh Para and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

The "Gogh Para" name, logo, and associated branding are trademarks of Gohi LLC. Unauthorized use is prohibited.

10. Limitation of Liability

To the fullest extent permitted by law, Gogh Para, its owner, employees, and supervising attorney shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or the information contained on it.

This limitation does not apply to claims arising from the provision of licensed legal paraprofessional services under a written service agreement, which are governed by the service agreement, applicable professional rules, and Minnesota law.

The Site is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Electronic Communications

By using this Site or contacting Gogh Para by email, you consent to receiving electronic communications from us. These communications may include appointment confirmations, case updates, invoices, and administrative notices. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

If you become a client, the method and frequency of case-related communications will be governed by your service agreement. You may opt out of non-essential marketing communications at any time by contacting us at support@goghpara.com.

12. Third-Party Links

This Site may contain links to third-party websites or resources. These links are provided for convenience only. Gogh Para does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. You access third-party websites at your own risk.

13. Indemnification

You agree to indemnify, defend, and hold harmless Gogh Para, its owner, employees, and supervising attorney from and against any claims, liabilities, damages, losses, or expenses (including reasonable fees) arising from your use of the Site in violation of these Terms or applicable law.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in the State of Minnesota. You consent to the personal jurisdiction of such courts.

This section governs disputes related to the use of the Site and these Terms only. Disputes arising from the provision of licensed legal paraprofessional services are governed by the terms of your service agreement and applicable professional rules.

15. Modifications to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Material changes to the refund policy or consultation fee structure will be clearly communicated and will not apply retroactively to existing engagements governed by a signed service agreement.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gogh Para regarding your use of the Site. These Terms do not govern the provision of licensed legal paraprofessional services, which are governed by a separate written service agreement executed between you and Gogh Para.
